Questions for the MAIN exam

  1. How far do you think the proposed National Data Governance Framework Policy presents a viable alternative to a dedicated data protection law? Justify your view.
  2. The judiciary should be able to evolve a mechanism of its own to preserve the democratic foundation of the country by intervening in the incremental process of the nation’s de-constitutionalisation. In the light of the statement discuss the importance of Article 142 to establish the rule of law.

QUOTATIONS AND CAPTIONS

  • Much unhappiness has come into the world because of bewilderment and things left unsaid.
  • There is an immediate need for policy and legislative forecasting as to what ought to be the most appropriate manner in which delimitation needs to be resumed, in light of the extensive structural changes over the past 50 years.
  • India’s top court cannot be seen to be helpless when faced with issues of individual liberty.
  • The criminal justice system in such tough times degenerates into rule by law, that replaces rule of law. The law becomes an effective device in the hands of the Government for the purposes of a witch-hunt and this operates against the opponents of a regime, as a class.
  • A constitutional court should be able to evolve a mechanism of its own to preserve the democratic foundation of the country by intervening in the incremental process of nation’s “deconstitutionalisation”.
  • The Court needs a new version of judicial activism, which the Court itself evolved, in the 1980s.
  • The genesis of Article 142 shows that the makers of the Constitution have consciously incorporated this provision by drastically modifying the earlier corresponding provision in the Government of India Act, 1935.
  • India might have made significant strides in population control in recent years, but there is no room for complacency.
  • GST is seen as a shining example of cooperative federalism aimed at taking the country towards a one-nation, one-tax and one-market regime.
  • The allocation for public healthcare becomes important when we consider the fact that most Indians shun the public health services due to their decaying state.
  • As war in Ukraine strangles global wheat supplies and extreme weather hits harvests, hardy and climate-resilient wild and ancient grains could bring greater food security.
  • There is an immediate need for policy and legislative forecasting as to what ought to be the most appropriate manner in which delimitation needs to be resumed, in light of the extensive structural changes over the past 50 years.

50 WORD TALK

  • Supreme Court’s call for a law to regulate arrest and bail passes the buck to the government to do what judges ought to do themselves. The court has held bail as a constitutional right and issued guidelines against unnecessary arrests. The new law isn’t needed to pull up erring trial judges or police.
